Dialogue with three major Muslim authors shows that Islam can take a positive stance toward human rights while also presenting differing interpretations of the meaning and scope of rights. Because of their subordination of norms reached through reason to those drawn from faith, as well as negative experiences of the impact of Western colonization of parts of the Muslim world, Abul A'la Maududi and Sayyid Qutb place significant restrictions on rights of conscience. 'Abdolkarim Soroush's positive support for the role of (...) reason in Islamic faith and his less-negative assessment of the West lead him to more vigorous support for the human rights agenda. David Hollenbach’s introduction explains how the book brings together Christian (mostly Catholic) theologians, human rights activists, humanitarian practitioners, and legal scholars to help us focus on a class of persons referred to as “forced migrants” or “persons needing protection.” These individuals are neither classical “convention refugees” (according to international law definitions) nor are they simply “migrant workers” (in the classical sense) since their basic human rights to security and subsistence cannot [End Page 230] be adequately guaranteed in their home country or region. They do not emigrate merely in search of a higher standard of living; rather, forced migrants enter and settle in foreign lands seeking some sort of “protection” similar to that afforded to “conventional” refugees. More concretely, the book focuses on persons on the move—individuals fleeing violence and the extreme poverty rampant in regions devastated by ecological degradation and natural disasters.Extending the logic of the 1952 Refugee Convention and adapting it to the realities of today, one can argue convincingly that the international community has a duty to protect such persons when their states of origin are structurally unable or unwilling to afford protection (as argued in Susan Martin’s essay). However, paternalistic approaches that diminish rather than augment the agency of local governments and migrants are to be avoided (as maintained in M. Brinton Lykes’ essay). The book helps us reflect on what can be done to guarantee the basic rights of forced migrants not only at the level of international law and institutions but also through domestic and regional policymaking spurred and inspired by both Christian and secular global-humanitarian values. Such values are eminently compatible when applied to this particular issue (see Silvano Tomasi’s contribution). Agbonkhianmeghe Orobator’s essay—which offers insightful reflections (albeit rather general ones) from Christian ethics, ecclesiology, and biblical theology—likewise points to the need for a truly interdisciplinary approach to the issue. The other authors help the book achieve precisely this. Theological ethics finds its own distinctive place and voice in dialogue with a range of perspectives: legal and political sciences and case studies (Frank Brennan, Daniel Kanstroom); philosophical approaches (Arash Abizadeh); and sociological research on particular migrant populations (M. Brinton Lykes, Maryanne Loughry). The book includes essays that integrate case studies, technical reflections, useful summaries of theological principles and doctrines (J. Bryan Hehir, Mary M. DeLorey, and Tomasi), and philosophical stances (Abizadeh, Thomas G. Weiss), and present practical and legal proposals (see Martin’s essay). A stimulating read for scholars and for the general public, the volume provides good training material for faith-based activists and practitioners.The argumentation strategy in many of the essays in Driven from Home is to appeal to the reader’s sense of solidarity with the needy or suffering neighbor. It promotes the virtues of hospitable citizenship and hospitable disciple-ship while carefully trying to convince national and international policymakers to reinforce and expand the international protection regime. Emboldened by the 2005 “Responsibility to Protect” breakthrough at the United Nations, the authors seek to remain acceptable to a wide audience in an atmosphere of resurgent nationalism, nativism, and protectionism. The authors generally avoid harsh critiques of Westphalian models of sovereignty and do not dwell [End Page 231] on the Catholic doctrines of the universal destination of created goods and the (circumscribed) right to immigrate (and not only to emigrate). The recent posthumous publication of John Rawls's undergraduate thesis 'A Brief Inquiry Into the Meaning of Sin and Faith: An Interpretation Based on the Concept of Community' constitutes a welcome opportunity to examine the relationships between Rawls's religious commitments and his political philosophy. In this essay, informed by a complete examination of Rawls's archived papers at Harvard, I set out some of these commitments, trace their development over time, and indicate some of the ways they find expression in Rawls's political (...) thought. In the 1990s Rawls characterized his life's work as addressed to a question 'essentially religious in nature': Can human nature be redeemed? It is perhaps, then, no surprise that reading his work against the background of his, eventually non-theistic, religious commitments and concerns helpfully casts it in a new light. (shrink)

This volume studies the teaching of Aristotle’s Nichomachean Ethics (the standard textbook for moral philosophy) in the universities of Renaissance Italy. Special attention is given to how university commentaries on the Ethics reflect developments in educational theory and practice and in humanist Aristotelianism. After surveying the fortune of the Ethics in the Latin West to 1650 and the work’s place in the universities, the discussion turns to Italian interpretations of the Ethics up to 1500 (Part Two) and then from 1500 (...) to 1650 (Part Three). The focus is on the universities of Florence-Pisa, Padua, Bologna, and Rome (including the Collegio Romano). Five substantial appendices document the institutional context of moral philosophy and the Latin interpretations of the Ethics during the Italian Renaissance. Largely based on archival and unpublished sources, this study provides striking evidence for the continuing vitality of university Aristotelianism and for its fruitful interaction with humanism on the eve of the early modern era. This article considers one element within the long tradition of the church’s self-identification as a city. It focuses on England, c. 1450 to c. 1510, and considers how the civic rhetoric developed by Italian humanists, pre-eminently Leonardo Bruni, was refracted through an ecclesiastical lens and so appropriated for English clerical use. It describes how two useful elements were quarried from recent writings imported from Italy: the first was the emphasis on the city and its buildings as a locus of virtue; (...) the second was that, because of its virtue, that city was under attack. The discussion begins with the time of social unrest in the mid-fifteenth century,in the wake of which Thomas Chaundler wrote his praise of Thomas Bekynton, bishop of Bath and Wells, and his building works in his episcopal city. It ends in the first years of the sixteenth century with the relations between Christopher Urswick, dean of Windsor, and Thomas Goldstone, prior of Christ Church, Canterbury. Their re-use of older texts, specifically the Speculum regis Edwardi III, which they assumed to be by Archbishop Simon Islip, and more recent humanist ones, by Celso Maffei and Goldstone’s predecessor as prior, William Sellyng, identified other enemies who attacked the church: invoking the name of Thomas Becket, they saw those oppressing them to be not rebels against authority but those in authority. This allows us to reflect on how a few English readers of humanist civic rhetoric found in it potentially radical force. (shrink)

Is something true because we believe it to be so or because it is true? How can a culturally bound community achieve scientific knowledge when values, attitudes, and desires shape its beliefs? In this book an eminent philosopher considers various schools of thought on the nature of truth. David Weissman argues that truth exists in the correspondence between statement and fact: what can be said about our world can be measured against a reality that has a character and existence (...) independent of any property we ascribe to it. Weissman begins by evaluating the transcendental paradigm of Kant that has exercised enormous influence in the development of Western thought over the past two hundred years. He develops his critique of the Kantian model, in which value judgments underlie the perception or construction of truth, asserting that it is seriously flawed because it renders a determination of truth impossible. Weissman examines various value-driven perspectives on truth developed by such philosophers as Foucault, Derrida, and Rorty, for whom truth is only the set of affirmations, principles, and procedures sanctioned by power and value. However, says Weissman, truth is the required adjunct to desire. Knowing who we are, where we have been, and the consequences of what we have done is the essential preparation for choosing what to do next. We must respect the integrity of a world we have not made and find our way within it with the help of attitudes and desires that have been informed by truth. (shrink)

As austerity measures are put into place the world over and global restructuring is acknowledged by all as an attempt to bolster the economic system that lead to the crash, there is a great need to come to grips with the economic, political and philosophical legacy of Marx. Of particular interest are Marx's analyses of alienation and the cycles of boom and bust thought to be integral to the functioning of capitalism. Moreover, as the Cold War drifts into the history (...) books, it is possible to reconsider the lasting impact of Marx's analyses without the shadows cast by the Soviet version of communism. Equally, though, scholars are increasingly turning to Marx for insight into the rise of religion and the corresponding demise of political ideologies that seems to mark the contemporary age. Are we witnessing 'the return of Marx'? Few scholars have done as much to tease out the intricacies of Marx, ideology and religion and their overlapping concerns as the eminent writer and Marx biographer, Professor David McLellan. This book brings together a group of internationally renowned academics to reflect upon, develop and criticise McLellan's analyses of these three themes with a view to contributing more broadly to scholarly debates in these fields. This exciting and timely analysis will be of interest to scholars of political theory, the history of political thought, Marx and Marxism, sociology of knowledge, religion and theology more widely. E.J. Lowe is one of the few philosophers who defend both the existence of spatially coincident entities and the Principle of Weak Extensionality that no two objects which have proper parts have exactly the same proper parts at the same time. Lowe maintains that when spatially coincident things like the statue and the lump of bronze are in a constitution relation, the constituted entity (the statue) has parts that the constituting entity (the lump) doesn’t, hence the compatibility with Weak Extensionality. (...) My contention is that his argument for why the statue has parts the lump of bronze lacks can also be used to show that the lump of bronze has parts the statue doesn’t. This will mean that there is no basis for saying the statue and the lump are in a constitution relation. I argue for accepting a modified account of constitution and abandoning the Principle of Weak Extensionality. (shrink)

Background: Studies have established that negative perceptions of people living with HIV/AIDS exist among nursing students throughout the world, perceptions which can be detrimental to the delivery of high-quality nursing care. Objectives: The purpose of this research was to explore socio-cultural influences on the perceptions of nursing students towards caring for people living with HIV/AIDS. Research design: The study was guided by stigma theory, a qualitative descriptive research approach was adopted. Data collected via semi-structured interviews were thematically analysed. Participants and (...) research context: Participants were 21 international and Australian undergraduate nursing students enrolled in a Bachelor of Nursing programme at an Australian university. Ethical considerations: Ethical approval was granted by the Social and Behavioural Research Ethics Committee at the study university. Participation was entirely voluntary; informed consent was obtained before the study commenced; confidentiality and anonymity were assured. Findings: Three major themes were found: blame, othering and values. Complex and interrelated factors constructed participant perceptions of people living with HIV/AIDS, perceptions underscored by the prevailing culturally construed blame and othering associated with HIV/AIDS. The study found discordance between the negative personal beliefs and perceptions some nursing students have towards people living with HIV/AIDS, and the professional values expected of them as Registered Nurses. Discussion: There was considerable commonality between this and previous studies on how homosexuality and illicit drug use were perceived and stigmatised, correlating with the blame directed towards people living with HIV/AIDS. These perceptions indicated some nursing students potentially risked not fulfilling the ethical and professional obligations the Registered Nurse. Conclusion: Nursing curriculum should be strengthened in relation to comprehending the meaning of being stigmatised by society. Educational institutions need to work towards enhancing strategies that assist nursing students to reconcile any incongruity between their personal beliefs and requisite professional nursing values. Abstract.This article focuses on a critical interpretation of the work of Unger. It is argued that Unger's view is less revolutionary than he depicts it and that American law often develops as Unger describes it, though this is absolutely no revolution. The authors further show what the possibilities and the limits of a transformative vocation at the bar can be.

This paper has three aims: first, to redeem some of Freud's most fundamental insights, so courageous and revolutionary that they were not even entirely appealing and intelligible to Freud himself; not understanding their teacher, Freud's disciples systematically distorted or suppressed his boldest speculations. By concentrating on an early Buddhist text of great profundity it is hoped to push our understanding of Freud beyond Freud himself. The exotic nature of this text makes it an especially powerful instrument for cutting through the (...) conservatism and resistance of venerable Freudian doctrine; secondly, to make more accessible a text which will encourage Western thinkers to do some serious thinking in the Buddhist way; and thirdly to examine the relationship between id and ego; it is shown why and how the egological construction (ego/superego) blocks the spontaneity of libidinal fulfillment. Imagine a model of the universe that, if true and known to be true, would solve the following philosophical problems: the direction and flow of time, an ontology for laws of nature, the interpretation of quantum mechanics, the interpretation of probability, a semantics for counterfactuals, trans-world and trans-temporal identity, essentialism and natural kinds, and free will and responsibility. The successful solution to these problems would convince most of us that we should, at the very least, give this model serious consideration. (...) This is the argument of Storrs McCall's A Model of the Universe: Space-Time, Probability, and Decision. Assume that the branched-tree model of the universe is true, and all these problems are solved. The idea of „rationality“ is still dominating in modern philosophical thinking. On one hand, there are philosophers who worship algorithms and formal structures of logical procedures. On the other hand there are those who tend to subjectivism, skepticism or relativism because of the impossibility to capture „God's eye view“ . By substituting the concept of „reasonableness“ for the idea of the „rational“ Stephen Toulmin hopes to avoid the relativistic trap.

David Hollenbach, working within the context of human rights theory, has developed the notion of "indigenous pluralism" as a means of coping with the problems that arise when different religious traditions hold distinct or incompatible interpretations of human rights. It will be argued that indigenous pluralism is a theoretically and practically useful concept for bioethics as well and hence should be incorporated into bioethical methodology and processes of bioethical policy formation. Subsequently, the notion of indigenous pluralism will be (...) discussed in relation to determinations of death as a means of illustrating this concept's applicability to bioethical inquiry. Reichenbach’s use of ‘posits’ to defend his frequentistic theory of probability has been criticized on the grounds that it makes unfalsifiable predictions. The justice of this criticism has blinded many to Reichenbach’s second use of a posit, one that can fruitfully be applied to current debates within epistemology. We show first that Reichenbach’s alternative type of posit creates a difficulty for epistemic foundationalists, and then that its use is equivalent to a particular kind of Jeffrey conditionalization. We conclude that, under (...) particular circumstances, Reichenbach’s approach and that of the Bayesians amount to the same thing, thereby presenting us with a new instance in which chance and credence coincide.
